Facebook passwords: why companies don?t use them to see your posts
Several states are considering laws to bar companies form asking for applicants? social media passwords. But the social-media world is easily mined even without passwords, experts say.?
From Connecticut to California, concern over a rise in employer demands for access to prospective employee?s social media logins and passwords is leading lawmakers to take action.
Skip to next paragraphThere is pending legislation in at least five states ? including Minnesota, Illinois, California, and Massachusetts ? and the Maryland legislature just passed its own version of a bill prohibiting the practice.
But as this groundswell grows, questions are rising about whether laws will actually stop employers from seeking out digital information in an increasingly digital age.
?There is a legitimate and growing concern about privacy on the Internet,? says Katharine Parker of Proskauer Employment Law Counseling & Training Group in New York, who advises employers on hiring practices and other HR issues. ?Is there any privacy on the Internet, should there be, and what laws are needed to regulate it are all questions that are just now being asked.?
Indeed, many experts say that companies do not need to ask for Facebook passwords to get information on applicants or employees. The notion that privacy settings make things on Facebook private ?is not necessarily accurate,? says Ms. Parker.
?Even if you have a lot of privacy settings on Facebook, it?s not private if you have lots of friends,? she says.
There are many ways to get information from applicants? social media without asking for their password, says Kabrina Krebel Chang, assistant professor of business law at Boston University?s School of Management.
?In many cases, the applicant is Facebook friends with someone already at the workplace,? she notes via e-mail.
There is nothing to stop that friend from showing others in the company the Facebook page. ?If there are no direct Facebook friends, many applicants are ?friends? of other pages or have liked other pages such as alma maters, interest groups, products, etc.,? Ms. Chang adds.
Human resources departments will simply switch to sending ?friend requests? to applicants and presenting this view of the individual during the interview process, says Charles Palmer, executive director of the Center for Advanced Entertainment & Learning Technologies at Harrisburg University of Science and Technology in Pennsylvania.
?It?s a little less overt and completely legal,? he says via e-mail, adding that he expects ?to see more investment into ?social forensics? to help weed out the applicant pool.?
The main thing for potential ? and current ? employees to remember is that any information that can be accessed on a computer is potentially going to be used in a hiring process, says Deborah Sweeny, CEO of MyCorporation.com.
Most people with time and the right knowledge and technology ?can access information that?s been posted online, even if it?s been posted to a social media profile that?s been made private,? she says via e-mail. Both employees and employers need to realize that anything they put online, could end up being public, she adds.
For these reasons, some experts think it is not only unnecessary but unwise for companies to ask for social media passwords.
?Once you ask for this kind of access, then you are on notice for anything that you might find,? says Todd Taylor, an attorney with Moore & Van Allen who specializes in communication technology. ?I would advise against going after information that isn?t already public for the simple reason that if you see something and you don?t act on it, you have the potential issue of a negligent hire down the road.?

ZTE Optik getting a minor update, brings some fixes and enhancements
Sprint is pushing out a small update for the 7-inch ZTE Optik today, bringing a few welcome bug fixes to the tablet and some decent software enhancements. According to the official changelog, we should be seeing the following:
- Google DRM solution
- Google Music
- Google+
- Persistent notification after BT transfer
- Software version corrected in x-wap profile
- Sim City closes when attempting to purchase while connected to Wifi
- Sim City download issue fixed
- Response when connected to a computer via USB cable
As the Optik ships with Honeycomb, Google Music and Plus weren't baked in. This update changes that and drops the Google services, along with unwanted, but necessary, DRM solutions into the system itself. Add in some small fixes for Bluetooth notifications, app specific bugs getting addressed, and hopefully a fix for the issue where a computer couldn't communicate via the USB cable and you have the makings of a nice little update here.
I just finished up the review for the Optik this weekend, but I'll hold it back a few days and check out this new update.

Klipsch Gallery G-17 Air
Editors' Note (4/11/2012): After the most recent version of iOS was released, the previously mentioned issue of interrupted AirPlay streams was cleared up. We have since tested and confirmed this, and as such have revised the review and score to reflect that improvement.
As AirPlay speaker systems increase in number?most of them still being referred to as "docks" despite a lack of an actual dock for an iPhone, iPod, or iPad?a few things are becoming increasingly clear. Almost all AirPlay docks are black, and the Klipsch Gallery G-17 Air is no exception. They are all pretty expensive?the G-17 is a hefty $549.99 (direct). For the most part, all AirPlay docks thus far offer quality audio, ranging from booming bass, as with the Audyssey Audio Dock Air ($399.99, 3.5 stars) to superb high fidelity sound, as with the Bowers & Wilkins Zeppelin Air ($599.95, 4 stars). The G-17 sounds excellent, and as of the most recent iOS update, has resolved the streaming issues we experienced in the past.?
Design
The rounded, glossy black piano finish of the Gallery G-17 Air is striking, as is the horizontal array of drivers?two 20-watt woofers in the middle and two 10-watt tweeters on the far left and right ends of the front panel. A small Klipsch logo and a remote sensor are the only other things on the front panel. All of the controls are located on the small right-hand side panel?Power, Volume, Input Select, and Wi-Fi, which is used for inital setup. The back panel houses the power cable connection, a 3.5mm Aux input, and a USB connection. You'll need a Phillips head screwdriver to attach the glass stand to the speaker unit (screws are included), but the G-17 is also wall-mountable. Also included with the G-17 and its stand: a rubber cover for the input panel on the back, a black cloth grille cover in case you want to hide the awesome looking drivers, a remote control, the power supply, an owners manual, and?seriously?white gloves, so your fingertips don't smudge the glossy black surface when you move the system.
The included remote can be frustrating to use?depending on the angle, and strength of the Wi-Fi signal, adjusting the volume can be a very delayed process. When the signal is good and the audio is streaming smoothly, the remote, which is a simple, thin, black plastic controller with membrane buttons, works fine. It has Power, Volume, Play/Pause, Skip Forward/Backward, and Input Select buttons.
Performance
The Gallery G-17 offers fairly powerful, refined audio performance for its size. There are four drivers but no subwoofer, and the net result is a audiophile-friendly flat response, devoid of booming deep bass but quite capable of articulating low frequencies well. Kick drums sound tight, not thunderous. Lower register stringed instruments sound pleasantly resonant, not overly boosted or booming. John Adams' modern classical piece, "The Chairman Dances," sounds neither overly bright nor rumbly. Instead, the G-17's response favors mid-range frequencies, occasionally allowing high frequency percussion hits, like wood blocks, to pop out from the more commanding force of the stringed instruments. At maximum volume on deep bass tracks, the G-17 doesn't distort, but this is partially due to the lack of booming bass pushed out by the speakers. Still, many systems that have no subwoofer try to reproduce deep bass frequencies with the result of distortion, and the G-17 avoids this problem. The Knife's "Silent Shout," at maximum volume, doesn't sound as thumping as it would on a system with a sub, but it does not distort either, and the bass frequencies are still well represented. Basically, the G-17 offers a nice, smooth response throughout the frequency range that doesn't exaggerate the lows or ignore them. Fans of accurate response over booming bass will be pleased.
Because AirPlay relies on Wi-Fi, it's dependent on the bandwidth of the local network. The more tasks being completed on the Wi-Fi network, no matter how un-taxing on the bandwidth, like sending an email, the more likely the stream is to pause, or stop completely. We have since tested the Klipsch Gallery G-17 Air again with the new version of iOS and experienced little to no interruption in the stream. This is a vast improvement over our initial tests of the speaker, and we have revised its score accordingly.
Apple is reportedly choosing to either switch to or include Bluetooth streaming into the AirPlay feature. Even a year or so ago, Bluetooth streaming was still a weak audio solution, with very little bass and low bit-rate fidelity. But recent developments have strengthened the audio quality greatly, as evidenced by recent Editors' Choices, the portable Bose SoundLink Wireless Mobile Speaker ($299.95, 4 stars) and the fantastic JBL OnBeat Xtreme ($499.95, 4.5 stars), which shows up as an AirPlay device on an iPhone or iPad, but uses Bluetooth. As of the most recent iOS update, AirPlay and Bluetooth seem to be similarly reliable.
The Bowers & Wilkins Zeppelin Air remains at the top of the list of AirPlay docks, in terms of audio performance, with the Klipsch Gallery G-17 close to the top with the most recent version of iOS. The streaming issues have been resolved, and it's now about as functional as a Bluetooth speaker, with excellent audio quality.?

NCAA puts Baylor basketball on 3 years' probation
WACO, Texas (AP) ? The NCAA put Baylor on three years of probation Wednesday after an investigation turned up hundreds of impermissible telephone calls and text messages sent to prep recruits by coaches and assistants on the basketball teams.
The violations were considered to be major infractions, and they were announced less than a week after the Lady Bears won the national championship with the first 40-0 season in NCAA history.
Still, it could have been much worse for Baylor. All of the penalties were proposed by the school and accepted by the NCAA after a review of nearly 900,000 phone and text message records found that 738 texts and 528 calls were against the rules.
The NCAA said men's coach Scott Drew failed to monitor his program and will be suspended for two Big 12 games next season, in addition to recruiting restrictions. Women's coach Kim Mulkey also received recruiting restrictions.
"I believe strongly in following NCAA rules and will always try to do so in the future," Mulkey said in a statement released by the school. "I do nothing without permission from our compliance office and will continue to ask questions to assure that things are done right. Any compliance-related mistakes, even those that are secondary, are disappointing. The majority of mistakes in this matter were errors in sending text messages and failure to accurately document our phone calls."
The report put a bit of a damper on what has been an extraordinary run of success for Baylor athletics.
Besides Baylor's win over Notre Dame for the women's title, Drew's team won a school-record 30 games and reached the NCAA regional finals, where the Bears lost to eventual national champion Kentucky. And all that came after star quarterback Robert Griffin III became the school's first Heisman Trophy winner following a football season that included 10 wins for the first time since 1980.
Mulkey was named the AP's national coach of the year and junior Brittney Griner was its player of the year. How Baylor recruited Griner, one of the most dominant women's players in college basketball history, was reportedly part of the NCAA probe.
A school report obtained by ESPN.com said Mulkey and her staff committed minor NCAA violations for having impermissible contact with Griner and her family. During a 2007 camp, coaches spoke with the Griners about the basketball program, academic requirements and the school in general both before and after the camp.
Mulkey also reportedly broke NCA rules when she sat next to Griner's father and discussed what the Baylor experience would be like. Brittney Griner, who is from the Houston area, played on the same AAU team as Mulkey's daughter, Makenzie Robertson.
The NCAA report did not mention Griner or her family by name, though Mulkey addressed it in her statement.
"The other matters were related to my daughter's participation in summer basketball," she said. "While I am and will always be a mother first, I do recognize that there has to be a balance between my role as a mother of a prospect and my role as a head coach. I have always tried to strike that balance and appreciate the opportunity to demonstrate to the NCAA staff such balancing efforts dating back to when Makenzie was in the seventh grade. I am pleased that my efforts to find the appropriate balance between a mother and a coach were recognized."
Griner said she had "made it clear to the NCAA staff and everyone else" that she had chosen Baylor early in the recruiting process.
Besides keeping Mulkey off the recruiting trail in July, Baylor said one of her assistants has been barred from making recruiting calls from January through April. The school also reduced its women's basketball scholarships from 15 to 13 in 2011-12.
On the men's side, Drew will miss the first two Big 12 games of the season, recruiting visits were trimmed and he lost a scholarship this past season and in 2012-13. In addition, a former coach faces a one-year "show cause" order that effectively prevents him from coaching at an NCAA school.
The assistant wasn't identified, but FOXSports.com reported in October 2010 that the NCAA was investigating the recruitment of Hanner Perea. The report said assistant Mark Morefield sent dozens of texts to Perea's AAU and high school coaches and urged two of them to provide false and misleading information to the NCAA about a series of text messages. Morefield resigned in July 2011.
"I sincerely apologize to Baylor University and Baylor Nation," Morefield said in statement released by his lawyer. "I learned a very valuable lesson in this case. In my 13 years of coaching at NCAA institutions, I have not intentionally violated NCAA rules. I will grow from this experience with a better understanding of NCAA rules."
The NCAA violations come nine years after Baylor basketball player Patrick Dennehy was found shot to death after he had been missing for six weeks. Teammate Carlton Dotson pleaded guilty to murder. The ensuing investigation uncovered NCAA violations, illegal tuition payments and unreported failed drug tests that led to the resignation of coach Dave Bliss, who was secretly recorded by an assistant coach of trying to persuade others to cover up misdeeds by portraying Dennehy as a drug dealer.
Athletic director Ian McCaw said the school has made "significant investments in compliance staffing and infrastructure" since the investigation began.
Drew said he took full responsibility for the violations, saying many were simply the result of improperly logging or failing to log calls to recruits. He noted that the school has a new software tracking system to assist coaches with the logistics.
"I came to Baylor in 2003 to do a job: rebuild a program decimated by very serious NCAA rules violations and tragedy," he said. "I promised to rebuild the program in a way Baylor could be proud-morally, academically and, finally, athletically, and we continue on that journey today."

WASHINGTON (MNI) ? The following is the Federal Reserve Beige
Book?s latest Sixth District economic assessment, published Wednesday:
Summary
Reports from Sixth District business contacts indicated that the
pace of economic activity expanded at a moderate pace in late February
through March. Expectations remained generally positive across most
sectors, although contacts expressed concern regarding the impact of
higher energy prices on the outlook.
Retailers mostly indicated sales were growing at a modest pace and
auto sales remained strong. Leisure and hospitality businesses reported
robust activity in all segments except cruise lines. Homebuilders and
brokers experienced improvements in sales of new and existing homes
while multifamily construction remained strong. General contractors
noted slow improvements in commercial construction conditions.
Manufacturers and transportation contacts reported positive production
trends, on balance. Loan demand remained relatively weak according to
community bank contacts. The share of firms reporting they were hiring
continued to increase, although many contacts continued to express a
preference for part-time or temporary contract workers. Most contacts
continued to report having relatively little pricing power. However, the
proportion of firms saying they were successful in their attempts to
pass on price increases rose since the last report.
Consumer Spending and Tourism
Most contact reports on consumer spending were generally positive.
Sales of home appliances, furniture, and autos were solid, while apparel
was more mixed. Most retailers remained optimistic that sales would
improve over the next three months, but noted that the impact of higher
gasoline prices posed a downside risk to their sales outlook.
Tourism activity remained strong and contacts were optimistic about
the outlook for leisure and hospitality spending in the summer.
Occupancy rates were up in many areas and South Florida continued to be
boosted by visitors from South America and Canada. Convention activity
continued to improve as well. Similar to retail, tourism contacts
expressed concern about higher fuel costs and the potential impact on
domestic travel to many regional tourist destinations. There continued
to be a modest drop off in bookings on some cruise lines, which was
attributed mostly to the recent disaster off the coast of Italy.
Real Estate and Construction
The majority of residential broker contacts reported that home
sales exceeded the year earlier level in late February and March. More
than two-thirds of the brokers indicated that sales met or exceeded
their expectations. Florida contacts noted strengthening sales,
particularly in South Florida markets. Many noted that inventory levels
across the District continued to decline on a year-over-year basis and,
in spite of this, home prices were flat to slightly down compared with a
year ago. The outlook among brokers for sales growth remained positive,
with most anticipating modest year-over-year gains over the next several
months.
The majority of homebuilder contacts reported that new home sales
and construction rose modestly during late February and March compared
with a year earlier. Similar to brokers, builders also noted that home
price declines abated somewhat and new home inventories continued to
decline on a year-over-year basis. Contacts observed that multifamily
construction remained robust across much of the District and new
projects continued to be announced. Over the next several months,
homebuilders anticipate sales and construction to be flat to slightly up
compared with a year ago.
Most commercial real estate contacts indicated that conditions
continued to improve slowly in the region. Contractors noted a slight
improvement in demand, but the market remained very competitive and
overall activity remained at low levels. Commercial real estate brokers
continued to report modest improvements in demand, mostly for class A
space in urban markets. Some reported that businesses have become more
willing to move ahead with lease plans. Rent concessions continued to be
noted with several brokers reporting that rates have begun to stabilize;
however, longer leases were reported which included generous tenant
improvements. The outlook among contacts was a bit more positive than
previously reported, but most contractors and commercial real estate
brokers continued to anticipate that activity would improve slowly this
year.
Manufacturing and Transportation
Manufacturing activity across the Sixth District improved compared
with the last report. Most contacts reported an increased level of both
new orders and production. Several large auto manufacturers announced
plans to hire more workers to meet increased demand for their products.
A major industrial equipment producer and two medium-sized manufacturers
announced plans to increase their presence in Georgia. Most
manufacturers also indicated some increase in non-labor input costs.
Transportation contacts continued to report volume growth across
most segments with the exception of air cargo, which is being hindered
by slowing global demand and rising fuel costs. A railroad contact noted
significant volume increases in automobiles, steel, and forestry
products. Domestic coal shipments slowed because of the effects of
warmer weather and lower natural gas prices. A port contact indicated
strong container volumes and increases in steel imports. The majority of
transportation contacts reported substantial investment spending in
anticipation of future demand.
Banking and Finance
Contacts at community banks indicated liquidity levels remained
high, a result of increasing deposit balances and relatively soft loan
demand. Some contacts acknowledged a slight increase in demand for C&I
and commercial real estate loans in some metropolitan areas, and a
general rise in demand for automobile loans. In rural areas, however,
low property valuations were said to be hindering overall loan activity.
The demand for mortgages varied widely by market and some community bank
contacts indicated that they have exited the mortgage origination market
altogether. Lending standards at these institutions have remained
largely unchanged. Smaller institutions noted tough competition from
larger banks for credit customers. Many of these contacts expressed
concern that regulatory compliance costs were affecting profit margins.

Alcohol Free or Low Alcohol Mulled Wine
Mulled wine, the quintessential Christmas drink, is normally alcoholic as it contains red wine and sometimes even brandy, but it needn?t be. If you have a stockist of non alcoholic or low alcohol content red wine near you, or have enough time to buy online, this can be a great way to emulate the taste without the potentially negative effects of binge drinking. If you can?t find non/low alcohol wine, don?t worry, just use cranberry or red grape juice instead.
Ingredients:
375ml low alcohol wine, non alcoholic wine, cranberry juice or red grape juice
375ml orange juice
1 large orange, halved and sliced
1 cinnamon stick
? tsp ground nutmeg
1 tsp ground ginger
Method:
Put everything into a pan and heat on the hob for 5 to 10 minutes until liquid is hot, but not boiling. Then turn the hob off and cover pan with a lid until ready to serve. Ladle into glasses and decorate with a few pieces of orange and a cinnamon stick in each glass.
Alcohol Free Warm Spiced Apple
Normally a drink made with cider, but there?s no reason why the alcohol free version made with apple juice, shouldn?t be equally delicious. The trick here is to buy good quality, fresh apple juice, not the made from concentrate stuff you normally find in supermarket?s own brand ranges.
Ingredients:
700ml apple juice
200ml water
100g brown sugar
? a lemon, sliced
? orange, sliced
1 cinnamon stick
? teaspoon ground nutmeg
Method:
Put everything into a pan and heat on the hob for 5 to 10 minutes until liquid is hot, but not boiling. Turn off the hob, strain liquid into a new pan and place back on the hob to keep warm from the residual heat. Cover with a lid until ready to serve. Ladle into glasses and decorate with a few pieces of orange or lemon.
Alcohol Free Eggnog
Another traditional Christmas drink, though now more popular in America than the UK. Eggnog is an egg based drink, which is more delicious than it sounds, which can be made with or without alcohol.
Ingredients:
3 large eggs, plus 1 yolk
475ml whole milk
60ml double cream
A pinch of nutmeg
A pinch of salt
? tablespoon vanilla extract
Method:
Whisk together eggs, egg yolk, sugar and salt. Then add milk slowly, whisking the whole time until the mixture is a smooth, even consistency.
Add the mixture to a pan and heat on the lowest hob setting until the mixture is thick enough to coat the back of a spoon. This may take 45 minutes to an hour, but don?t be tempted to turn up the heat ? this will cause the eggs to scramble.
Strain the mixture into a jug or bowl and stir in the vanilla extract and nutmeg. Then cover and refrigerate until chilled ? this will take around four hours.
When the mixture is cool, whip the double cream until it makes soft peaks, and then fold in to the chilled mixture.
Virgin Mary
As Christmas is the celebration of Jesus? birth, what could be a more topical drink than the Virgin Mary, the Bloody Mary?s alcohol free cousin. Easy to make, but also great to order if you?re out and about, as most bars will stock the ingredients for this and can easily make it without alcohol.
Ingredients:
1,200ml tomato juice
Tabasco sauce to taste
Worcestershire sauce to taste
The juice of a lemon
A pinch of salt and pepper
A celery stick per glass, to garnish
Method:
Pour tomato juice into a jug and add lemon juice. Then season with Tabasco sauce, Worcestershire sauce and salt and pepper to taste. Stir well and serve over ice with a stick of celery to garnish.

Sahara states at odds over Mali rebels
NOUAKCHOTT (Reuters) - Sahara Desert states differed on Sunday over whether to crush or talk to the rebels who have seized northern Mali - a mix of Tuareg separatists and Islamists with links to al Qaeda.
At a meeting of regional countries in Mauritania, Niger said the rebels' gains should be reversed before any talks, but Algeria warned that military intervention risked further complicating the situation.
The rebels, bolstered by guns and fighters from Libya's war last year, routed Malian troops, in disarray after a March 22 coup, to carve out a zone the size of France and declare an independent state of "Azawad".
Mali's government had long had a weak hold over its northern zone, but its neighbours now fear a void that will exacerbate regional instability, terrorism and smuggling.
Mauritania, Algeria, Niger and Mali had set up a joint military command headquarters before the lightning rebel push, although it had struggled to coordinate efforts against what they see as an Islamist threat in the Sahara.
Niger, which has suffered its own sporadic Tuareg rebellions, said there could be discussion of some of the demands of the separatist National Movement for the Liberation of Azwad (MNLA).
But Foreign Minister Mohamed Bazoum echoed international rejection of the group's claim for independence as "absurd and unacceptable".
"We need to work to redress the balance of forces on the ground before we can talk about negotiations," Bazoum said at the opening of the meeting in Mauritania's capital, Nouakchott.
"We need to organise a confrontation with the terrorist groups ... Mali's north must be cleared of terrorism and it seems to me we have the ideal opportunity," he said.
West Africa's ECOWAS group had been mulling an intervention to prevent any further rebel push until the coup meant restoring civilian rule became the regional bloc's priority.
The junta pledged on Saturday to leave power within days, paving the way for the possibility for an intervention but it remains unclear when boots could be put on the ground.
Bazoum said Niger, Mauritania and Algeria, as Mali's closest partners in the north, should engage in diplomacy but be ready to intervene militarily, if needed.
Algeria, the region's biggest power, took a different tack, saying talks were the only way out. France, colonial ruler over all the states at the table, has also pushed for dialogue with the separatist rebel movement.
"The solution can only be a political one. It cannot be the result of a military effort which could instead worsen an already complex and precarious situation," Abdelkader Messahel, Algeria's delegate minister for African affairs, said.
Algeria's position in Mali has been further complicated by the kidnapping last week of its consul and six other staff from its mission in Gao, one of the northern towns seized by rebels.
Algeria's El Watan newspaper reported on its website on Sunday that the diplomats had been freed, but Algerian officials in Nouakchott were unable to confirm that.
Nearly a week after Malian government forces were completely routed across the north, it remains unclear which groups really control main towns or swathes of territory.
The MNLA separatists, which are more prominent in Gao than the Islamists, denied any involvement in the kidnapping.
Ahead of the El Watan report that the diplomats had been freed, French RFI radio said MUJWA, a splinter group from al Qaeda's North Africa wing, AQIM, had claimed the kidnapping.

'Berry pink' Galaxy Note launches in Korea

If the one thing standing in the way of your buying a Galaxy Note was the lack of a garish pink shell, then you'll be pleased to see that Samsung has addressed your concerns with today's launch of the Note in "berry pink" in South Korea. It's unclear whether Samsung plans to plans to bring this model to international markets, but for now it says it's targeting "the female consumer and the younger generation" with the new pink Note. Naturally, it includes a equally pink "S Pen" stylus and optional pink protective cover. The pink version will join the white and "carbon blue" versions which have been available since late October 2011.
Perhaps a little more interesting to smartphone nerds outside of Korea is the appearance of ICS-based software in today's promotional images for the pink Note -- that's unmistakably the ICS, not Gingerbread search widget in the image above. Then again, we've known for some time that the Note is due an update to Android 4.0, so it's not too surprising to see the updated software shown off in a promotional shot.
The "berry pink" Samsung Galaxy Note launches today in stores across South Korea.
